KidSwapsTerms of ServiceEffective Date: April 11, 2026These Terms of Service govern your use of the KidSwaps membership service, website, and member portal operated by KidSwaps LLC, a California limited liability company. By creating an account or using our service, you agree to these terms in full. If you do not agree, do not use the service.Questions about these terms may be directed to: jennie@kidswaps.com
1. The ServiceKidSwaps is a curated children's clothing and toy swap membership service. Members send in outgrown items, earn credits based on the tier of each accepted item, and use those credits to claim items from the KidSwaps collection. Membership is available to adults 18 years of age or older residing in the United States.We currently accept clothing in sizes 6M through 4T and toys meeting our published Closet Standard. KidSwaps reserves the right to modify the accepted size range, categories, and eligible brands at any time with reasonable notice to members.
2. Membership PlansKidSwaps offers the following monthly membership plans:The Basics — $30 per month — 6 clothing trades per monthThe Full Wardrobe — $45 per month — 10 clothing trades per monthThe Everything Bag — $70 per month — 10 clothing trades and 3 toy trades per monthThe Toy Chest — $45 per month — 5 toy trades per monthStarter packs are available as one-time purchases for members who wish to begin shopping before sending in a swap bag:Clothing Starter Pack — $75 — 5 Essentials clothing creditsToy Starter Pack — $85 — 5 Essentials toy creditsYour monthly trade allowance is the maximum number of trades you may make per billing cycle. Unused trades do not carry forward. Credits earned through item acceptance do carry forward for up to 12 months from the date earned.
3. Billing and PaymentYour first membership charge occurs when your first swap bag is received and processed, not at the time of signup. Monthly billing renews on that date each month. All payments are processed securely through Stripe.By providing payment information you authorize KidSwaps to charge your payment method for your monthly membership fee and any applicable additional charges including upgrade fees, extra swap fees, and shipping upcharges.Stripe charges a transaction fee of 2.9% plus $0.30 per transaction on all payments. This fee is incorporated into our pricing.Sales tax may be applied to your order in accordance with applicable state and local laws.
4. CreditsCredits are the only currency in the KidSwaps system. Every accepted item earns one credit at its tier level — Essentials, Elevated, or Special. Credits are used to claim items from the KidSwaps collection on a like-for-like basis within the same tier.The following rules govern credits:Credits carry forward automatically for up to 12 months from the date they are earned.Credits expire at the end of the day on their expiry date. Members may use credits on the day of expiry.Credits expire immediately and permanently upon cancellation of membership. Credits have no cash value and will not be refunded or redeemed for cash under any circumstances.Clothing credits may only be used to claim clothing items. Toy credits may only be used to claim toy items.Credits redeem on a like-for-like tier basis. Claiming an item at a higher tier than your available credit requires payment of an upgrade fee.Credits are non-transferable and have no value outside the KidSwaps platform.
5. Monthly Trade CapYour membership tier sets the maximum number of trades you may make per billing cycle. This cap resets automatically on your billing date each month. You may not exceed your monthly trade cap even if you have available credits. Additional trades beyond your cap are available for a flat fee of $5 per trade plus applicable shipping costs.
6. Upgrade Fees and Extra Swap FeesIf you wish to claim an item at a higher tier than your available credit, an upgrade fee applies. The upgrade fee is calculated as the actual retail value of the item you want minus the actual retail value of the credit you hold. Both values are pulled from our inventory records at the SKU level. The upgrade fee will be displayed to you clearly before any charge is applied. You must confirm the charge explicitly before it is processed.Extra swap fees of $5 per additional trade apply when you have reached your monthly trade cap. Shipping costs are charged separately at actual cost and will be displayed before confirmation.All upgrade fees and extra swap fees are final and non-refundable once an item has shipped.
7. The Closet StandardAll items submitted to KidSwaps must meet The Closet Standard, our published quality and condition guidelines. Items that do not meet The Closet Standard will not be accepted and will not be returned. Non-accepted items will be donated to local charitable partners on your behalf.By submitting items to KidSwaps you represent that you have the right to transfer those items and that they meet The Closet Standard as published on our website. You agree that our grading decisions are final, subject to our published dispute process.A photographic record of every accepted item is maintained before shipment. If you believe an item you received does not match its listing, you must contact us within 7 days of delivery with supporting photographs. We will review your claim against our pre-shipment record and respond within 48 hours. Our decision is final.
8. Return PolicyAll swaps are final. Credits used to claim items are non-refundable once an item has shipped.We will replace your credit and arrange return shipping at our cost in the following circumstances:We sent you the wrong item.An item arrived in materially worse condition than its listing described.A toy arrived with missing pieces that were listed as included.We do not replace credits for change of mind, style preference, or sizing variation between brands. Kids sizing varies significantly across brands and we are not responsible for fit differences. Size information is provided as listed on the item tag.If an item arrives damaged in transit, contact us within 7 days of delivery with photographs. We will file a claim with our shipping carrier and replace your credit while the claim is processed.All return and replacement claims must be submitted to jennie@kidswaps.com within 7 days of delivery.
9. Cancellation and Pause PolicyYou may cancel your membership at any time with no cancellation fee. Your membership remains active through the end of your current billing period. No refunds are issued for the current billing period. Credits expire immediately upon cancellation and have no cash value.You may pause your membership once per 12-month period for a maximum of 2 months. Credits freeze during the pause period and resume when your membership reactivates. Billing resumes automatically at the end of your pause period. You will receive a reminder 7 days before your pause ends. If you do not cancel before your pause ends, your membership reactivates and billing resumes automatically.
10. Tier ChangesYou may upgrade or downgrade your membership tier at any time through your account settings.On upgrade, Stripe will automatically calculate and charge a prorated amount for the remaining days in your current billing period. You will be informed of this prorated charge before upgrading. Existing credits remain active. Your monthly trade cap increases immediately to the new tier level.On downgrade, existing credits remain active until their natural 12-month expiry. The downgrade takes effect at your next billing cycle. Your monthly trade cap adjusts to the lower tier immediately.
11. Referral ProgramWhen a member you referred sends in their first swap bag and earns their first credits, both you and the new member will receive 3 Essentials credits each. Referral credits are issued in the form of credits only — not cash — and are subject to the same terms as all other credits including the 12-month expiry and cancellation policy.KidSwaps reserves the right to modify or discontinue the referral program at any time.
12. Intellectual PropertyAll content on the KidSwaps website and member portal including text, images, logos, and design is owned by KidSwaps LLC or its licensors. You may not reproduce, distribute, or create derivative works from our content without written permission.
13. Disclaimer of WarrantiesThe KidSwaps service is provided on an as-is and as-available basis. We make no warranties, express or implied, regarding the quality, completeness, or fitness for a particular purpose of any item in our collection. Secondhand items may show signs of normal wear consistent with their condition grade. We make no guarantee of inventory availability in any specific size, brand, or tier at any time.
14. Limitation of LiabilityTo the maximum extent permitted by California law, KidSwaps LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability to you for any claim arising from your membership shall not exceed the amount you paid to KidSwaps in the 3 months preceding the claim.
15. Arbitration and Dispute ResolutionAny dispute arising from or relating to these Terms of Service or your use of the KidSwaps service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in California. Each party shall bear their own costs unless the arbitrator determines otherwise.By agreeing to these terms you waive your right to participate in a class action lawsuit or class-wide arbitration against KidSwaps. You may opt out of this arbitration provision by sending written notice to jennie@kidswaps.com within 30 days of first accepting these terms.
16. Governing LawThese Terms of Service are governed by the laws of the State of California without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved in the courts of California.
17. Changes to These TermsWe may update these Terms of Service from time to time. We will notify you of material changes by email. Your continued use of the service after notice of changes constitutes acceptance of the updated terms.
